TENNESSEAN OFFICIAL RULES
1. NO PURCHASE NECESSARY TO ENTER OR TO WIN. A PURCHASE WILL NOT INCREASE YOUR ODDS OF WINNING. ALL FEDERAL, STATE, LOCAL AND MUNICIPAL LAWS AND REGULATIONS APPLY. VOID WHERE PROHIBITED.
2. Eligibility. Subject to the additional restrictions below, Bracket Envy (the “Contest”) is open to Tennessee and Kentucky residents who are 18 years or older at the time of entry. Employees of The Tennessean, (“Sponsor”), Gannett Co., Inc, UPICKEM, and each of their respective affiliated companies, and advertising and promotional agencies, and the immediate family members of, and any persons domiciled with, any such employees, are not eligible to enter or to win.
3. How To Enter. The Contest will begin at 9:00 a.m. (C.T.) on March 17, 2008 and end at 11:59 p.m. (C.T.) on April 6, 2008 (the “Contest Period”).
Internet Entry: Enter by visiting the Bracket Envy official registration page on the The Tennessean’s website (Tennessean.com) and completing all of the required information and following all posted instructions. Your computer must accept cookies, or any successor or similar technology, which may be used for the purpose of entry tracking. Complete the entry form and any other required fields and then submit your entry by clicking on the “SEND” button. By entering, you agree to the terms of these Official Rules and to receive e-mails from Sponsor or those directed by Sponsor. You can opt-out of the receipt of such e-mails by following the directions on the Contest website or in any email received from Sponsor. Maximum one (1) entry per person.
Sponsor will not be responsible for incomplete, lost, late, misdirected or illegible entries or for failure to receive entries due to transmission failures or technical failures of any kind, including, without limitation, malfunctioning of any network, hardware or software, whether originating with sender or Sponsor. In the event of a dispute, all online entries will be deemed to have been submitted by the owner of the ISP account from which they were sent. For these purposes, an ISP account holder shall mean the natural person assigned to such ISP account by the Internet access provider, online service provider or other organization responsible for assigning ISP addresses for the domain associated with such ISP account. All entries become property of Sponsor and none will be returned. Any questions regarding the number of entries submitted or the owner of an ISP account shall be determined by Sponsor in its sole discretion, and Sponsor reserves the right to disqualify any entries by persons determined to be tampering with or abusing any aspect of the Contest.
4. Winner Selection. One (1) Grand Prize Winner will be selected on April 8, 2008. The Winner will be determined based on the most points accumulated. Each round of the Contest is worth 64 points. There are 6 rounds that total up to 384 points. First round games are 2 points each. Second round games are 4 points each. Third round games are 8 points each. Fourth round games are 16 points each. Fifth round games are 32 points each. Final championship game is worth 64 points. In the event of tie, ties are broken as follows: For rounds 1 through 6 - the computer will apply the "Score Approximation Formula" as follows: -- Subtracts what the score selected by the entrant for the winning team from the actual winning team's score and squares this value. -- Subtracts what the entrant chose as the score for the losing team from the actual losing team's score and squares this value. -- Adds 1 and 2 above together to get the entrant’s "score approximation". If there is still a tie after determining winner(s) based on the "score approximation" then a random winner(s) is selected from those entrants who are tied. For the Grand Prize Winner: If there are ties for overall score the computer takes applies the score approximation formula outlined above to all entrant’s who are tied. If there are entrants who are still tied, the computer selects a winner beginning with: -- The most points earned in the Fifth Round. -- The most points earned in the Fourth Round. -- The most points earned in the Third Round. -- The most points earned in the Second Round. -- The most points earned in the First Round. -- If there is still a tie, a random winner is selected from the tied entrants.
5. Prizes and Odds. One (1) Grand Prize Winner will receive $500. There are also national prizes provided by UPICKEM that will be awarded. See site for rules.
Odds of winning depend on the number of eligible entries received.
6. Winner Notification and Acceptance. Winners will be notified on or about April 9, 2008 at the telephone number or email address provided on winner’s entry form. Sponsor will call during regular business hours at number provided on entry form and will leave no messages. Failure to reach winner by email or by phone, after three attempts, may result in disqualification of winner, forfeiture of his or her interest in all prizes, and selection of a substitute winner from among all remaining eligible entries. To claim prize, each winner must personally visit Sponsor’s offices at at 1100 Broadway, Nashville, TN within five (5) business days after notification (office visits must be between the hours of 9 a.m. (C.T.) and 5 p.m. (C.T.) weekdays) and a valid photo identification may be required. Winners may waive their right to receive prizes. Prizes are nonassignable and nontransferable. No substitutions allowed by winner. Prizes and individual components of prize packages are subject to availability and Sponsor reserves the right to substitute prizes of equal or greater value. Winners are solely responsible for reporting and payment of any taxes on prizes. Winners may be required to complete an affidavit of eligibility/liability and publicity release (except where prohibited by law) which must be returned within ten (10) days of date of personal delivery or date of postmark. Failure to sign and return the affidavit or release within ten (10) days, or to comply with any term or condition of these Official Rules, may result in a winner’s disqualification, the forfeiture of his or her interest in the prize, and the award of the prize to a substitute winner. Except where prohibited, acceptance of any prize constitutes winner’s consent to the publication of his or her name, biographical information and likeness in any media for any commercial or promotional purpose, without limitation the Internet, or further compensation. Prizes not won and claimed by eligible winners in accordance with these Official Rules will not be awarded and will remain the property of Sponsor. 7. Participation. By participating, entrants agree to be bound by these Official Rules and the decisions of Sponsor. Sponsor reserves the right to disqualify persons found tampering with or otherwise abusing any aspect of this Contest as solely determined by Sponsor. In the event the Contest is compromised by a virus, non-authorized human intervention, tampering or other causes beyond the reasonable control of Sponsor which corrupts or impairs the administration, security, fairness or proper operation of the Contest, Sponsor reserves the right in its sole discretion to suspend, modify or terminate the Contest. Should the Contest be terminated prior to the stated expiration date, Sponsor reserves the right to award prizes based on the entries received before the termination date.
8. Construction. The invalidity or unenforceability of any provision of these rules shall not affect the validity or enforceability of any other provision. In the event that any such provision is determined to be invalid or otherwise unenforceable, these rules shall be construed in accordance with their terms as if the invalid or unenforceable provision was not contained therein. The Contest and all of the related pages, contents and code are copyright, UPICKEM.com, Inc., and Sponsor. Copying or unauthorized use of any copyrighted materials, trademarks or any other intellectual property without the express written consent of its owner is strictly prohibited.
9. Sponsor. Bracket Envy is sponsored by The Tennessean. The decisions of Sponsor regarding the selection of winners and all other aspects of the Contest shall be final and binding in all respects. Sponsor will not be responsible for typographical, printing or other inadvertent errors in these Official Rules or in other materials relating to the Contest. No purchase necessary. One valid entry per contestant.
You must be 18 years of age or older at time of entry to be eligible for this contest. This contest is void where prohibited by law.
Winners will be notified by email. If a winner is unreachable after seven (7) days, or if that winner is unavailable for prize fulfillment, an alternate winner will be selected. If UPICKEM.com or its affiliates cannot find an eligible winner for the prize, that prize will not be awarded.
Odds of winning depend on the number of eligible entries received.
UPICKEM.com and its affiliates reserve the right to substitute any prize with another prize of equal or greater value.
Affiliates reserve the right to restrict the local winners to only persons whose primary residence is within the affiliate's' coverage area.
Employees of UPICKEM.com and its affiliates, their respective parents, affiliates, subsidiaries, advertising sponsors and promotional agencies, and the immediate family members of each are not eligible.
Employees of UPICKEM.com and its affiliates, their respective parents, affiliates, subsidiaries, agents, successors, and assignees of UPICKEM.com, its advertising agencies and promotional companies involved in this Promotion, as well as family and household members of same, shall be ineligible to participate in the Promotion and shall be ineligible for any prize covered herein. The parties acknowledge that SCA Promotions, Inc., is not liable for reimbursement of any prizes otherwise payable to Promotion contestants who are in violation of this provision.
Names and likenesses of winner(s) may be used by UPICKEM.com and UPICKEM.com's designee(s) for promotional purposes without further compensation to UPICKEM.com or the winner(s).
Contest entrants agree to abide by the terms of these Official Rules and by the decisions of the contest commissioners, which are final on all matters pertaining to the contest.
Entrants further grant to UPICKEM.com and its affiliates the right to use and publish their proper name and state online and in print, or any other media, in connection with the Contest.
UPICKEM.com and its affiliates reserve the right to use any and all information related to the Contest, including information on contestants obtained through the contest, for marketing purposes or any other purpose, unless prohibited by law.
The Contest and all of the related pages, contents and code are copyright, UPICKEM.com, Inc., and/or its affiliates. Copying or unauthorized use of any copyrighted materials, trademarks or any other intellectual property without the express written consent of its owner is strictly prohibited.
Each winner, by acceptance of the prize, agrees to release all Sponsors, and their parent and subsidiary companies, their officers, directors, employees, agents, shareholders, affiliates, suppliers, distributors, and advertising agencies from all liability, claims, or actions of any kind whatsoever for injuries, damages, or losses to persons and property which may be sustained in connection with the receipt, ownership, or use of the prize.
UPICKEM.com and its affiliates are not responsible for Internet crashes or slowdowns caused by network congestion, viruses, sabotage, satellite failures, phone line failures, electrical outages, natural disasters or acts of man or God.
If a game is canceled, forfeited, or indefinitely suspended for any reason, or if a game results in a tie, that game shall not count for any contestant and scores will be computed as if the game did not exist.
All results posted are unofficial until winners respond to e-mail notification.
Each winner is responsible for all federal, state and local taxes and will be required to complete an IRS form W-9. Sponsor reserves the right to withhold prizes until completed form W-9 is received.
Each round of the tournament is worth 64 points. There are 6 rounds in the tournament that total up to 384 points. First round games are 2 points each. Second round games are 4 points each. Third round games are 8 points each. Fourth round games are 16 points each. Fifth round games are 32 points each. And the final championship game is worth 64 points.
Ties are broken as follows: For rounds 1 through 6: Fans pick who they think is going to win along with the score for a designated tie-breaker game. The computer then takes all the fans who are tied and applies this "Score Approximation Formula" outlined in points 1-3 immediately below: 1. Subtracts what the fan chose as the score for the winning team from the actual winning team's score and squares this value. 2. Subtracts what the fan chose as the score for the losing team from the actual losing team's score and squares this value. 3. Adds 1 and 2 above together to get the fan's "score approximation". If there is still a tie after determining the "score approximation" then the computer than chooses a random winner from those who are tied.
For the overall winner: If there are ties for overall score the computer takes those fans that picked the championship game correctly and applies the score approximation formula outlined above. If there are still ties the computer looks at who had:
1. The most points earned in the Fifth Round. 2. The most points earned in the Fourth Round. 3. The most points earned in the Third Round. 4. The most points earned in the Second Round. 5. The most points earned in the First Round. 6. If there is still a tie the computer picks a random winner from the tied players.
Fans can only only win one of the cash prizes outlined below. So, for example, a $100,000.00 winner cannot also win a $10,000.00 or $1,000.00 prize and a $10,000.00 winner cannot also win a $1,000.00 prize.
One (1) $100,000.00 cash prize could be awarded to an eligible fan who picks all 63 games in the contest correctly. If there are more than one (1) verified winners the prize award will be evenly divided between all winners.
Up to five (5) $10,000.00 cash prizes could be awarded to eligible fans who pick 61 or 62 games in the contest correctly. If there are more than five (5) verified winners the prize awards will be evenly divided between all winners.
Up to ten (10) $1,000.00 cash prizes could be awarded to eligible fans who pick 60 games in the contest correctly. If there are more than ten (10) verified winners the prize awards will be evenly divided between all winners.
Determination of cash prize winners, verification of eligibility, and compliance with these rules will be conducted by SCA Promotions, Inc., whose decision will be final.
All decisions of the judges are final.
This contest is not intended for gambling. If it is determined that a contestant is using the contest for gambling purposes they will be disqualified and reported to authorities.
UPICKEM and its affiliates reserve the right to change the rules at any time.
